Outdoor Fires
Pursuant to the laws of the Cayman Islands, please note that outdoor fires are not allowed.
Worry-Free Hurricane Policy
If a hurricane warning is issued for the Cayman Islands by the National Hurricane Center within seven days of your scheduled arrival date, you may call or email Governors Village at stay@gvcayman.com to reschedule or cancel your reservation and receive a full refund. If a hurricane warning is issued during your stay and you are forced to depart early, a refund will be issued for any unused nights. Please note that our hurricane policy is only applicable on reservations booked directly with Governors Village.
Force Majeure
Governors Village shall not be liable for any circumstances beyond our control, including, but not limited to, acts of God, acts of governmental agencies, fire, strikes or labor shortages, wars, floods, storms, pandemics or epidemics, inclement weather, or any other events or circumstances not within the reasonable control of GV, whether similar or dissimilar to any of the foregoing (“Force Majeure Event”). In the unlikely event that the Property becomes untenantable, unavailable or otherwise unsuitable for occupation because of a Force Majeure Event as determined in the sole and absolute discretion of GV, the following applies.
Force Majeure Event After the Arrival Date
Governors Village will attempt to relocate the Rental Party to similar or better accommodations. Should acceptable accommodations not be available, however, the aggregate liability of Governors Village shall be limited to the Guest’s choice of either a prompt refund of all unearned Rental Charges paid, or a future stay at the Property of equal or lesser value of all unearned Rental Charges paid, subject always to availability.
Force Majeure Event Prior to the Arrival Date
Unless otherwise refundable pursuant the Cancellations provision above, Governors Village shall not be obligated to offer a refund because of a Force Majeure Event. Should Governors Village determine in its reasonable directions that the Property will likely remain unavailable for more than one year from the original arrival date or should the Property remain unavailable for more than one year from the arrival date, Governors Village shall issue a prompt refund of all unearned Rental Charges paid. The aggregate liability of Governors Village shall never exceed the unearned Rental Charges paid.
Fraud, Misrepresentation, or Violation
If a reservation has been obtained under false pretenses, or in the event the Guest or the Rental Party (or any other persons granted access to the Property during the Lease Term) violates any term of this Agreement, the Property Owner shall have the right to deny check-in or evict the Rental Party without refund.
Dispute Resolution
The Guest, on his or her own behalf and on behalf of each member of the Rental Party, agrees that any controversy or claim arising out of or relating to this Agreement, or the breach thereof, shall be submitted to the exclusive jurisdiction and venue of the courts of the Cayman Islands. The Guest, on his or her own behalf and on behalf of each member of the Rental Party, specifically agrees not to dispute or otherwise initiate a chargeback of any payments or deposits processed via credit card if such payments or deposits arise out of or relate to any claimed payment obligation due under this Agreement and whether such payment obligation is in dispute. The Guest, on his or her own behalf and on behalf of each member of the Rental Party, further agrees to instead resolve any such dispute in a court of competent jurisdiction in the Cayman Islands. If the Guest or any member of the Rental party successfully disputes or otherwise initiates a chargeback of any payments or deposits processed via credit card which relate to any claimed payment obligation due under this Agreement in violation of this provision, it is expressly agreed that the Guest shall be liable to Governors Village for the amount of any such chargeback and that all defenses as to the validity of the charges in question are waived in any subsequent legal proceeding. If any legal action or proceeding is commenced to construe or enforce this Agreement in a court of competent jurisdiction in the Cayman Islands, then the party prevailing in that action, and any appeal thereof, shall be entitled to recover its attorneys’ fees and costs in that action or proceeding, as well as all costs and fees of any appeal or action to enforce any judgment entered therein.
Beach and Water Entry
The beaches and water entries around the island of Grand Cayman may vary throughout the year due to circumstances beyond our control, including erosion, storm activity and other naturally occurring phenomena. No discounts or refunds are given if the beach or water entry around the Property varies from the images on our website or the Rental Party’s expectations.
Beaches throughout the Caribbean, including along the island of Grand Cayman, may also experience an accumulation of sargassum from time to time. Sargassum is a generally harmless seagrass that is more unsightly than anything else and that offers a valuable turtle nesting ground. Although sargassum accumulation may occur at any time, the condition is largely seasonal and tends to be most apparent in late summer months. Fortunately, Grand Cayman does not ordinarily see the extraordinary accumulations that can plague other Caribbean destinations from time to time. Should you encounter undue accumulation of Sargassum during your stay, please contact the Governors Village operations team for suggestions of unaffected beaches.
Water and Power
Tap water in the Cayman Islands is desalinated sea water and is safe to drink. Please note that the water desalination process and the production of electricity on island have a significant adverse impact on the precious local marine environment. Although water and electricity are included in your stay, please conserve accordingly, including by keeping doors and windows shut while the air conditioner is running.
Tropical Climate
Tropical climate without air conditioning produces mold and causes rust to develop on metal fixtures and fittings. The Guest agrees to keep the air conditioning running at all times, regardless of whether the guest or the rental party are in the premises. The Guests must set the thermostat at a temperature between 72°F (22°C) and 78°F (26°C) to avoid mold or rust.
Potential Noise and Activity Disclaimer
While we strive to provide a tranquil and comfortable environment for our guests, please be aware that the Seven Mile Beach Corridor is a vibrant and evolving area. As such, from time to time, there may be noise or activity from nearby properties or developments.
1. General Awareness: Guests should understand that, due to the nature of the area, occasional noise or disturbances may arise from various activities, including but not limited to construction, renovations, or other operations in the vicinity. These occurrences are a normal part of the area’s ongoing growth and vibrancy.
2. No Guarantees of Silence: While we make every effort to ensure a peaceful stay, we cannot guarantee the absence of external noise or disturbances, which are beyond our control. The surrounding area’s activities may vary.
3. Limitation of Liability: We kindly inform our guests that we are not liable for any inconvenience or discomfort caused by external noise or activities from neighboring properties. As these events are outside our management, we are unable to offer refunds, discounts, or compensation related to such disturbances.
4. No Obligation to Relocate: Should there be any noise or disruptions during your stay, we will, of course, listen to your concerns. However, please note that we are under no obligation to provide alternative accommodations or refunds, as these disturbances are part of the natural ebb and flow of the area.
5. Communication Encouraged: We encourage guests to communicate any concerns during their stay, and we will do our best to address them within our capacity. However, please understand that certain situations, particularly those involving external sources, may be beyond our control.
By proceeding with your booking, you acknowledge and accept these conditions. We appreciate your understanding and look forward to welcoming you.
